What categories of personal data do we process?
In order to undertake our activities, we process personal data under the following categories:
- Data of representatives and individuals related to legal persons which provide services and deliver goods to us: identity, contact information, position and faculties.
- Data of representatives and individuals related to the private and public legal persons belonging or associated to the energy sector: identity, contact information, position and faculties.
- Data of representatives and members of stakeholders with public influence in the energy sector: identity, contact information, position, faculties, public statements.
- Identity, contact and invoicing data of landowners.
- Clients: contact information, position, information available from public sources in the energy sector.
- Data of applicants to positions in Altano: work experience, professional skills, identity and contact data.
Why do we process your personal data?
Your data will be processed for the following purposes, based on the following categories of data subjects:
- Landowners: Your data will be processed in order to be able to adequately perform your signed contract and apply the measures requested during the pre-signature phase. In other words, your data will be processed for:
- Registration with the Land Registry of the aforementioned contract.
- The necessary steps before a Notary in order for the contract to be formalised in a public deed.
- Informing the Public Administrations, seeking to obtain the necessary permits and licences for the development, construction, operation or dismantling of the project associated to your contract.
- Adequate development, construction, operation or dismantling of the project associated to your contract. This includes communication of your data to the natural or legal persons in charge of execution of the works.
- Independently verifying the absence of conflicts of interest and compliance with money laundering legislation.
- Obtaining the necessary funds for execution of the project. Specifically, for compliance with your contractual obligations on the assignment of receivables. All guarantee and risk insurance operations are deemed included.
- Acquiring or transferring the project assets, including movable assets or real estate owned by you.
- Clients: We process your data to be able to contact you, provide you with offers in the context of negotiations and render the agreed services.
- Suppliers of goods and services: Your data and/or those of your representatives and staff will be processed to correctly perform the contract signed with you.
- Purposes applicable to all the above categories: In order to undertake our activities, your personal data may be processed in compliance with tax and money laundering legislation. Additionally, your data may be processed to allow the necessary authorisations or licences to be obtained by Altano, for its activities.
- Candidates: To complete personnel selection processes, following Altano’s criteria.
- Your data will not be subject to automated decision-making
What is the lawfulness of this processing?
The lawfulness of Altano’s data process is described below:
- This processing is necessary to execute the contracts that Altano signs with you.
- Simultaneously, when the processing involves tax or money laundering obligations, among other aspects, Altano needs to comply with its legal obligations.
- When you contact Altano for the first time, it is in our legitimate interest to respond to your request and/or apply any pre-contractual measures requested. Altano’s legitimate interest is compatible with your interest in having us respond to your request.
- When you send us your CV, it is in our legitimate interest to collect your data, without prejudice to subsequently requesting your consent. This legitimate interest is based on the fact that the appropriateness of processing the data collected complements the candidate’s interest.
- In cases of structural changes, contributions or transfers of business or areas of activity, this processing will be assumed legal, in accordance with article 21 of Spanish Act 3/2018 of 5th December on Personal Data Protection and to guarantee digital rights.
Who may receive your personal data?
Your data may be disclosed to third parties in the following scenarios:
- Obtaining licences, administrative authorisations: Your data may be disclosed to the bodies of any Administration if required in order for Altano to obtain activity authorisations or licences.
- Compliance with tax, money laundering and other legislation: Your data may be notified to the Tax Administration or the Executive Service of the Commission for the Prevention of Money Laundering and Monetary Offences. Additionally, your data must be provided to any competent Notaries Public and Registrars when formalising documents in a public deed and registering transactions over assets or rights.
- Court requirements
- Altano’s business management: Your data may be notified to other entities of the Altano Group; likewise, during the purchase or sale of assets, your data may be provided to the parties involved in the transaction; finally, the processing of your data may be assigned to third parties, as explained in the following section.
To whom can we assign our personal data processing?
The processing of your data may be assigned to third parties. These third parties may be classified in the following categories:
- Providers of main services: Companies subcontracted for the provision of services or execution of works directly related to performance of your contract; financial or insurance entities; compliance services; legal and/or tax advisors.
- Auxiliary services: Providers of intermediary information society services, or providers of documentary management, accounting and office automation services.
Existence of international transfers
Your data may be transferred to third countrie. If any change arises, we will duly inform you in advance, certifying that decisions are taken on its adequacy, adequate safeguards, or the applicability of any exception, as set out in articles 44 to 49 of the General Data Protection Regulation.
How long will we keep your personal data?
Your data will be processed for as long aa necessary to achieve the purposes described in Section “Why do we process your personal data?” above. Specifically:
- Your personal data will be kept during the term of your contract or for the duration of our legal processing obligation, as applicable.
- If your data need to be processed in the context of the development, operation or dismantling of an energy project, the storage time will be accordingly extended to be able to handle all associated obligations.
- For CV data processing, the storage time will refer to the duration of the selection process, without prejudice to Altano obtaining your consent in order for this processing to continue. If the candidate sends his/her CV outside a specific job vacancy period, Altano will keep these data for 12 months.
How can you exercise your rights?
You may exercise your rights of access, rectification, erasure, objection, limitation on processing and portability and not being subject to individualised decision-making by writing to info@altanoenergy.com, attaching a copy of your identity document
You have the right to receive a reply within one month. This period may be extended by 2 more months if your request is complex or if we receive a number of requests which delays our normal time of response.
